Deposit & Cancellation Terms:
A 50% deposit is required at booking to confirm your reservation and is fully refundable until 60 days prior to arrival. The remaining balance is due 60 days before arrival and will be automatically charged to the payment method on file. All payments are non-refundable within 60 days of arrival.
Reservations booked through an online travel agency are subject to that agency’s payment and cancellation policies, which may differ from ours. In the event of a conflict, the OTA’s policies will prevail.
All Daugherty Management properties require Tenant to be at least 32 years old to book a reservation. Travel insurance policies are highly recommended.
Terms of the Rental Agreement:
- Check-in time is 4:00PM, and check-out time is 11:00AM.
- The Landlord may inspect the Premises at any time to enforce this Agreement. Any violation of this Agreement may result in immediate termination of the rental period. Upon termination or expiration, Tenants must vacate the Premises and waive any right to notice or process if they fail to do so.
- Tenants shall keep the premises clean, in good condition, and rental-ready, use it lawfully and with care, follow the check-out procedures in the digital Guest Guidebook, and be responsible for repair or maintenance costs if the property is left in poorer condition.
- Tenants must properly dispose of all trash generated during the rental period and place it in the designated garbage containers. Trash should not be left outside, as it may attract wildlife.
- The Tenants shall pay for any damage done to the premises over and above normal wear and tear.
- Properties are not pet-friendly unless expressly advertised as such. Only domesticated dogs are permitted in designated pet-friendly homes, limited to 1 or 2 dogs depending on the property, and subject to a $125 non-refundable pet fee. All other animals are prohibited. Unauthorized pets will result in charges for all necessary professional cleaning to remove pet hair, dander, or waste from the premises.
- No weddings, bachelor or bachelorette parties, or events of any kind are permitted on the premises.
- Occupancy is limited to the maximum number of guests agreed upon for the reservation. RVs, camper trailers, motorhomes, tents, or similar items are not permitted on the Premises at any time. Under no circumstances may anyone reside or sleep in such items or connect them to the Premises’ utilities, even if permission is granted for their presence.
- Tenants shall behave respectfully, be good neighbors, and avoid noise or disturbances that may annoy or disturb surrounding property owners. Quiet hours are from 10:00 PM to 8:00 AM. Violations may result in immediate termination of this agreement and removal from the premises.
- Smoking is not permitted in or on the Premises.
- Tenants and their guests shall indemnify and hold harmless the Landlord, Daugherty Management, LLC, its owners, and employees from any claims of injury, damage, or loss arising from use of the Premises. Tenants acknowledge that any insurance maintained by Landlord does not cover Tenant or guest personal property, and Tenants are encouraged to obtain their own coverage if desired.
- Tenants agree to reimburse the Landlord for all reasonable costs, expenses, and attorney’s fees incurred in enforcing this Agreement, to the extent permitted by law.
- Tenants expressly acknowledge that this Agreement is for transient occupancy and that they do not intend to establish residency or a household at the premises.
14. No refunds or compensation will be provided for power outages, weather, environmental conditions, shortened stays, or unmet expectations. This includes disruptions caused by air or water quality, snow conditions, work or family emergencies, or other personal circumstances.
- Tenant is responsible for understanding and following all safety precautions and warning signs related to lake and hot tub use. Minors must be supervised by a responsible adult at all times near water. Tenant acknowledges that the lake can be dangerous and accepts all risks associated with its use.
- Only legally owned firearms permitted under state and local law are allowed on the Premises. Recreational discharge of firearms is prohibited.
- Fireworks and or other hazardous materials are prohibited in or around the Premises.
- The Premises may be used for lawful purposes only. Any illegal use of the Premises may result in immediate termination of this Agreement without refund of rent or deposits.
- Tenant agrees not to access any “owner’s closet”, even if unlocked.
- Tenants must promptly notify the Landlord if the fire extinguisher is missing or not fully charged.
- Tenant shall promptly notify Landlord if any smoke detector chirps, shows a low-battery signal, or appears to be malfunctioning.
- Found valuables will be held for Tenant. Unclaimed items become Landlord’s property after 30 days. Landlord is not liable for their condition.
- Wireless internet is provided as a convenience and is not part of the rental agreement. No refunds or compensation will be provided for internet outages, speed, access issues, content availability, or personal preferences.
- Not all properties have air conditioning. Where applicable, Tenant agrees that air conditioning shall not be set below 70 degrees and heat shall not be set above 76, and that doors and windows shall be closed while either heat or air conditioning is in operation.
- Tenants may not sublet or assign this Agreement.
- Amenities and appliances are provided as a convenience and may occasionally be unavailable due to malfunction or maintenance. While reasonable efforts will be made to restore service during your stay, functionality is not guaranteed and no refunds or compensation will be provided for unavailable or non operational amenities or appliances, including but not limited to air conditioning, internet, hot tubs, boat lifts, kitchen appliances, or washer and dryer units.
